Apple vs. Samsung Lawsuit: Judge Lucy Koh Dismisses Other Apple Inc. (AAPL) Trial

Apple Inc. won a victory in court over the Cupertino-based company's private policy.

According to San Jose, Calif., U.S. District Court Judge Lucy H. Koh, the four plaintiffs, who claimed Apple violated its private policy regarding its iOS platform, failed to show how the company caused them damage.

The plaintiffs stated Apple's iOS was designed to transmit personal data to third-party companies without the consent or detection of the user. In addition, the plaintiffs added they spent too much money on purchasing their respective iPhones and lost storage space on their devices.

Judge Koh, who also presides the ongoing patent infringement case between Apple and Samsung, dismissed the lawsuit.

The Nov. 25 ruling by Judge Koh stated, "Plaintiffs must be able to provide some evidence that they saw one or more of Apple's alleged misrepresentations, that they actually relied on those misrepresentations, and that they were harmed thereby."

According to Reuters, Apple or the plaintiffs' lawyers have yet to respond to requests for comments or declined to issue a statement.

As Latino Post reported, Koh is also the judge of the Apple vs. Samsung patent infringement trial in the U.S. In the latest developments, Apple's Senior Vice President of Worldwide Marketing Philip Schiller answered questions by attorneys as the court determines the financial damages Samsung owes Apple. The retrial focuses on 13 Samsung products, which Apple claims infringed on their "bounce-back" feature when the device owner reaches at the end of a document, among other allegations.

The current trial between Apple and Samsung will determine how much money the South Korean-based organization has to give Apple following the $1.05 billion verdict in August 2012. Judge Koh reduced the $1.05 billion verdict by 40 percent, or $450.5 million, stating the original jury miscalculated the cost of several Samsung products.
