Kanye West & Kim Kardashian’s Lawsuit vs Ex-Youtube CEO Over Marriage Proposal Leak to Proceed

Between Bruce Jenner's transformation, Kendall's modeling jobs, and whether or not Kylie has been getting cosmetic surgeries at eighteen, it seems that there is another event that we should be keeping up with the Kardashians, and that is the lawsuit that Kim and her rapper husband Kanye West are currently pursuing.

According to The Associated Press (AP), a California Appeals Court has allowed Kim and Kanye to proceed with their lawsuit over the leaked footage of their wedding proposal. In 2013, the couple sued YouTube co-founder Chad Hurley when he posted a video of the rapper's elaborate proposal to the socialite on his new website, MixBit.

The proposal was the rapper's gift for his now-wife on her 33rd birthday, Rolling Stone noted. The event took place in October 2013 at the San Francisco AT&T Park. The couple's family and close friends witnessed the proposal which featured the performance of the Chicago Symphony, along with a Jumbotron message that read "PLEEEASE MARRY MEE!!!"

After it was decided that the case will proceed, Hurley's lawyers appealed the ruling, but the 2nd Court of Appeal in Los Angeles upheld the decision last Wednesday, saying that Kim and Kanye have "shown a likelihood they can win a case on claims of breach of contract, fraud, and unjust enrichment," AP wrote.

Hurley, who was reportedly present during the proposal, immediately leaked the footage on to MixBit, but the special moment was meant to be the highlight of KUWTK season back then. Kim and Kanye said that Hurley snuck into the park with the intention of filming the elaborate proposal, and was only allowed to stay in the property after signing a non-disclosure agreement, Rolling Stone added, citing the lawsuit. 

Hurley then argued that the confidentiality agreement he signed did not extend to MixBit but this was ruled to be lacking in merit, AP explained further.

In their statement, Kim and Kanye stated that "Hurley proceeded to try to turn the event into one starring himself, broadcasting the images he knew were the exclusive property rights of someone else." They claimed that Hurley was using their proposal to drum up business for his new site.

The couple has not specified how much they are seeking from Hurley for damages, though USA Today noted that in a statement, the couple's attorney said, "By improperly advertising Mr. West's and Mrs. Kardashian West's intellectual property on his new website, Mr. Hurley got significant value that must be reimbursed to my clients."
